The terms that govern your use of CarCrowd, and how we handle your personal information.

These Terms of Service ("Terms") govern your use of the CarCrowd website and services, operated by CarCrowd Pty Ltd (ABN 38 686 749 208, ACN 686 749 208) ("CarCrowd", "we", "us", "our"). By registering your interest, browsing the website, or otherwise using our services, you agree to these Terms.
1. What CarCrowd does
CarCrowd is a demand coordination platform for new car buyers in Australia. We group buyers who are interested in the same vehicle, negotiate a single crowd price with a participating dealership on behalf of that group, and pass that price on to everyone in the crowd. CarCrowd is not a dealership, broker, or lead generation service, and we do not sell vehicles. The contract for the sale of any vehicle is between you and the participating dealership, not CarCrowd.
2. Registering your interest
Registering your interest in a vehicle through CarCrowd is free and creates no obligation to purchase. We use the details you provide (including your name, email, state, vehicle preference, and approximate buying timeframe) to assess demand and notify you if and when a crowd price becomes available for a vehicle you've registered interest in.
3. How a deal works
When enough buyer interest exists for a particular vehicle, we negotiate a crowd price with a dealership and notify the relevant registered buyers. Deals are specific to a vehicle, variant, and Australian state, and are only open to buyers in the relevant state. If you choose to participate in a live deal, you may lock in your place by paying a refundable deposit through our payment provider, Stripe.
4. Deposits and the CarCrowd participation fee
The deposit amount is shown on the relevant deal page at the time you lock in. Your deposit is fully refundable if the deal does not proceed for any reason, including if the crowd does not reach the required size or if you choose not to proceed with a purchase before the deal closes. If you go on to complete your vehicle purchase with the participating dealership, your deposit is retained by CarCrowd as our participation fee for coordinating the deal, and is not separately payable to the dealership.
5. Driveaway pricing and dealer handover
Crowd prices shown on CarCrowd are driveaway prices for the base specification of the listed vehicle and variant. Colour and optional extras are chosen directly with the dealership after your crowd price is locked in, and may incur additional cost beyond the crowd price. Once a deal closes, you will be connected directly with the participating dealership to finalise your vehicle specification, paperwork, and purchase. CarCrowd is not a party to that purchase contract and is not responsible for the dealership's conduct, the vehicle's condition, or any warranty, finance, insurance, or after-sales matter, which are governed by your agreement with the dealership and applicable law.
6. No guarantee a deal will proceed
We do not guarantee that any deal will reach its target crowd size, that a deal will proceed, or that a specific price, discount, or vehicle will remain available. CarCrowd may modify, pause, or cancel a deal at any time before it closes.
7. Eligibility
You must be at least 18 years old and an Australian resident to register or participate in a deal. Some deals are restricted to buyers in a specific state, as shown on the relevant deal page.
8. Your consumer rights
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
9. Limitation of liability
To the maximum extent permitted by law, CarCrowd's liability to you in connection with these Terms or your use of our services is limited to the amount of any deposit or fee you have paid to us. CarCrowd is not liable for any loss arising from your dealings with a participating dealership.
10. Intellectual property
The CarCrowd name, branding, website content, and underlying technology are owned by CarCrowd Pty Ltd or our licensors. You may not copy, reproduce, or use them without our written permission.
11. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on this page, and continued use of our services after an update means you accept the changes.
12. Governing law
These Terms are governed by the laws of Victoria, Australia, and any dispute is subject to the exclusive jurisdiction of the courts of Victoria.

This Privacy Policy explains how CarCrowd Pty Ltd (ABN 38 686 749 208) ("CarCrowd", "we", "us", "our") collects, uses, discloses, and protects personal information, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
1. Information we collect
When you register your interest or participate in a deal, we collect information including your name, email address, state, vehicle make and model preference, and approximate buying timeframe. We also automatically collect some technical information when you visit our website, such as device type, referring website, and campaign source data.
2. How we collect it
We collect this information directly from you when you complete a registration form or unlock a deal page, and automatically through standard website analytics as you browse.
3. How we use it
We use your information to match you with relevant crowd deals, notify you when a crowd price is available, communicate with you about your registration or deposit, and improve our service. We do not use your information to make automated decisions that significantly affect you.
4. Who we share it with
We share your information with the following third parties, only as needed to provide our service: Stripe, our payment processor, to process deposit payments (CarCrowd does not see or store your full card details); Zapier and Google, to securely route and store registration data; Microsoft 365, to send confirmation and update emails from concierge@carcrowd.com.au; and the participating dealership, but only once you choose to lock in or proceed with a deal, and only to the extent needed to connect you and finalise your purchase. We do not sell your personal information to third parties, and we do not share it with dealerships who are not part of a deal you've chosen to participate in.
5. Overseas disclosure
Some of the service providers listed above (including Stripe, Google, and Microsoft) may store or process information on servers located outside Australia. We take reasonable steps to ensure these providers handle your information securely.
6. Data security
We take reasonable steps to protect your personal information from misuse, loss, and unauthorised access, including restricting access to registration data and relying on the security measures of our service providers.
7. Access and correction
You can request access to, or correction of, the personal information we hold about you at any time by contacting concierge@carcrowd.com.au.
8. Complaints
If you have a concern about how we've handled your personal information, please contact us first at concierge@carcrowd.com.au. If you're not satisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
9. Cookies and website data
Our website may use basic cookies or similar technology to support normal website functionality and understand how visitors use our site.
10. Changes to this policy
